Musk committed fraud, and he did it publicly. It’s really not debatable that he violated SEC regulations, it’s just a matter of what the punishment will be.

There are already class action lawsuits, and there will be more now that the SEC has validated the fraud claims. They will be settled, and it will cost a not-insignificant amount of money.

Q3 results are coming out soon. Musk promised profitability and positive cash glow in Q3 and Q4. It’s not going to happen, which will drive down the share price even more.

Without positive cash flow, TSLA will need to go to the market to get more cash to fund operations by the end of the year. With interest rates rising and the company in turmoil, borrowing costs will be punitive.

There is nothing preventing him from raising capital while under the investigation. He has to disclose the investigation. At this point no underwriter will touch it, because there is risk for underwriters. No underwriter will touch investigated company, if he doesn't disclose on filing the investigation, the SEC will go in for non disclosure. So you have to disclose, and underwriters will not touch it, because they run the risk if something material happens during an offering of getting stuck with this shit. Even though theoretically Tesla can do a secondary, there is no rule saying they can't. But the IBs don't take this risk. i dont expect you idiots to have an access to scientific papers, but you can check results here. this is a massive shill for pv getting their propaganda out, and even they admit that pv is not as good as other renewables.
the problem is that they made multiple mistakes in their shilling shitpaper:
1) they only consider tracking solar panels, and even then fail to compensate that those capture about ~90% of total energy (they assume 100%). non tracking panels (the vast majority) only capture about 50%. so you can multiply their pay-back time by x2;
2) they omit any additional electronics costs (such as inverters, regulators, etc), basically just handwave them away. you can multiply pay-back time by additional x1.2;
3) they also omit frames and additional parts of the panel. basically they only include the cells and some minor components (like connecting wires). you can multiply pay-back time by additional ~x1.5;
4) they failed to compensate for pv aging and assumed constant efficiency over the panel lifetime. old panels lose as much as 50% of their efficiency over 12 years. newer ones are a lot better, but they also lose ~20% over 10 years. youll also need to change toughened glass after 10 years, which again has its own carbon footprint. you can multiply their pay-back time by another x1.5;
5) they also fail to account for reduced efficiency due to increased temperature. multiply the pay-back time by another x1.2;
6) to their credit, they were too pessimistic with their predictions on efficiency advancements. they assumed that panels in 2020 will be ~18% efficient, when in reality the current average is a bit over 20%. multiply their pay-back time by ~x0.9.
so all-in-all you have about 20 years of actual pay-back time.
