16528251 No.16528251 [Reply] [Original]

Here's the moment Anders gave away the name Holochain. (https://medium.com/@deicidus/thank-you-for-writing-this-32c16010204a))
He just said it in a medium post. This is not grounds for a lawsuit at all. It's not trademarked and this Anders guy is being milked by his legal representation.

And here's Arthur Brock (a founder of Holo/Holochain) acknowledging the acceptance and use of the name. This is not grounds for a trademark dispute because Anders literally gave the name away. If Anders was using the name commercially prior to giving away the idea then he MIGHT have a case to enforce and injunction to cease and desist using the Holochain name but there's obviously no evidence of Anders using the name at all so therefor the case will be dismissed on the 19th of December and Anders will have nothing but shame and a negative bank balance which will see his solicitor's bank balance increase.

and that's not even a good analogy because a flower itself has value on it's own. The word holochain didn't have any value when that kid came up with the name. The project gave the word value just if it had any other name, that name would hold the value now because of the good will that has been generated by the product itself. The word had no value when he said it so that's how much he'll get from this feeble effort to try and extract value from it after the fact.

Just because you divulge your invention to people doesn't mean you're waiving the rights to it.
If that were true, we would never learn of a single copyrighted song, book, movie, ...

>> No.16529309

>>16529282
and that's the whole reason Arthur trademarked it. To protect the good will that was being attached to the word so little fucktards like himself couldn't try and pass off the good will of the product and reputation of the organisation as his own. This is why trademarks are registered.

>> No.16529335

>>16529299
copyright on creative works are completely different to trademarks. If you give away your ideas to somebody, that's your own fault. Ideas are not property. Creative works are copyrighted automatically upon their recording in any form. Patents for inventions are a whole other ball game which are a lot more difficult to obtain but if you do divulge your invention to somebody before obtaining a patent you basically have no rights to it in the eyes of the law. That's the whole purpose of the USPTO, (United States Patent and Trademark Office) to protect your ideas.

No that's not right either. It's your idea and you can patent it then maybe you will be protected by the law if somebody copies it and makes money from your invention. I am a trial attorney who has studied intellectual property law extensively. Your argument completely misses how IP works.

For example, what intellectual property law is your idea/an idea protected under?

An idea alone is not trademarkable, it's not patentable, and it is definitely not copyrightable. You can obtain property protection of your idea via contract, such as an NDA. However, there was no NDA or contract regarding the idea here.
