In many ways it does indeed act like a security. Counter-argument is that you don't get any shares of Ripple by buying XRP, it is indeed thus a currency
Defense uses a provision established in a SCOTUS case in 1946 to make their case and the SEC is intending on challenging that case and their case is strong
If they win it would impact Ripple but only Ripple alone because they're toeing a very fine line. They have a valid defense but the accusation is strong as well
