Tokens/coins being a security has nothing to do with whether they're printed or mined.

Not even a lawyer but that language isnt close to a death knell. I’m sure the lawyers can squirm out of it. “Problem” is an open-ended word here.

Why are they so afraid of ripple?

>> No.25055957

Well, to be fair Larsen and the other crooks have done very well for themselves, so I guess even if SEC clamps down on them and the US exchanges delist XRP as a result, it is mission accomplished for them - they are all billionaires and SEC will get the blame for screwing over what should've been a great project.

Ripple says they "engage in strategies" that "strengthen the exchange rate".

In other words, Ripple is telling people that they are doing work to pump the price or phrased another way an Expectation of Profit through the Efforts of the Promoter.

i'm telling you if you create any digital token convertible to fiat and sell it to someone the sec will call it a security.

if you create a digital token like an in-game currency that is not exchangeable back to fiat and not tradeable so it can't have an economy of it's own then it's not a security.

No.

There's long-standing precedent from SCOTUS, see the whiteboard in >>25055718
