XRP as a security AND currency?

Guys I was talking to my uncle at christmas who has worked in finance his whole life. We knows I am in to crypto and he almost immediately asked me about my holdings and how I was doing. We got on the topic of the SEC suit very quickly and this was his take.

He thinks Ripple did offer what amounts to an unregistered security and will likely be found guilty BUT he is 100% convinced XRP will be labeled a currency by the SEC. He thinks they are going to pay some hefty fines but he said "there is no scenario where XRP is currently classified as a security because current use prohibits it. That doesn't mean it WASNT at one point". He thinks this was a natural evolution of finance and this case is going to be basically a precedent setting event for crypto that will allow other tokens to operate with more clarity.

My next question was "how long will it take?" and he said "typically years but I wouldn't be surprised if this is finished in a month, there is real urgency there."

Anyways, that's what I got from him. Dude is rich, like 20 - 30 million if I had to guess. Owns a few contracting and real estate companies.
