It's much easier for them to prove they did their due diligence in measuring how many bots there are on the platform than it is for musk to prove they were intent on lying about their bot problem in official filings. Capturing the "number of bots" necessarily would rely on twitter being competent or even motivated enough to record such statistics which brings up the question of why you would invest in such a company in the first place if you dont think they are reliable; including up to actually filing papers to buy.

There is no perfect standard for catching a bot on any internet service.
