I'm an idiot and this might be a wendy's but I know the story of that one guy that bought all(100%) the shares of his company and the stock was still shorted(into bankruptcy I believe) and I'm pretty sure they were not registered in his name, that is a true story. If your shares are with a broker, then they are allowed to do whatever they please with them within the terms of service(which a lot of people don't read), the brokers are the custodian of those shares even though they don't technically own them, but it's basically like they do.
