In this case what the restructuring plan details is, the ‘successor entity’ to BBBYQ/etc. is essentially going to be a skeleton office whose sole responsibility is going to be supervising the sale or winding-down of remaining assets. Here is my take since the only people going through this are meltdownies who out of context whatever they can. The plan is not posted yet. Holders can be settled reasonably with the court. Whoever is the Plan Administrator is covering themselves legally (every way possible) so they can't be fucked with. Court delays, paper work, legal, accounting expenses will be dealt with using current reserves. The more current reserves the less the (bond folks) may receive during waterfall. No claims to the company after court approval besides what the plan admin posts soon (protecting path forward), given the parties agree. No one can come after the plan admin after they do this, etc. Reasonable compromises with "any agreement, instrument, or other document entered into in connection with or pursuant to the Plan or the Liquidation Transactions, all notes, bonds, indentures, certificates, Securities, shares, purchase rights, options, warrants, collateral agreements, subordination agreements, intercreditor agreements, or other instruments or documents directly or indirectly evidencing, creating, or relating to any indebtedness or obligations of". The plan will be shared and we will know if shareholders are reasonably settled with a share of a new company or not, and if the bondies are settled with cash compromise or shares. Most of this IMO is heavy legal language so if this unknown plan is implemented, nobody can come back in a week or a year and make a claim with something that was not stated here.
