If something is in plain sight, why would you get mad when people see it. This is the general argument most people hold.
For someone to photograph or record it, it can be creepy or not, that depends on the person and their morals.
There is an separate argument about if you can see it in plain sight and stand in an area where photography/video is allowed (which most events and public spaces allow), you should expect it at some point.

This is all well and good, but do you think anyone ever makes sure they have the consent of people in the background? It isn't even possible because it's a public area with a high volume of traffic. If cosplay =/= consent only applies to the main subject of the photo, it's a bullshit standard. I've never seen people snagged in the background of pictures complain, even though they never consented verbally — because they consented by fucking going there. Really, the actual idea behind the concept is that particular cosplayers want to control the way they're seen and publicized, despite the fact that people can just look, remember really well, and crank it to the memory, if we're talking about 'being creepy'.

That's definitely without people's explicit consent. How did people find, let's say, the Aurora shooter so quickly? Perhaps the issue is "don't publish without consent", but that still only has the main subject in mind, so it's a useless platitude. I think the argument is now divided on two fundamentally different aspects, now. Previously, the idea that the "Consplay =/= Consent" crowd was trying to focus on was that, essentially, sexual predators were using photos to exploit their targets. Both sides have agreed that this is an actual thing, and have nominally said that they wish for this to stop.

The opposing side, of which I belong, wants to bring into light the obvious sexual connotations for dressing up in "sexy" clothing. The terms are tied together - if you are wearing sexy clothes, then the intent is to be sexually attractive. While some of my... well, I certainly won't call these dribbling semi-lucid fucks my "peers", but those that share this viewpoint get distracted by the varying degrees of sexually appealing clothing some of these women wear and ignore the heart of the issue.

Men that attend these events in costumes and clothing that is meant to be sexually appealing know that they are entering a place where people will grant them varying degrees of attention for their antics. Take the Pokemon Men group, for example - almost all of them are nearly shirtless, and, let's face it, other than that Ash and Pikachu fuckin' none 'dem bitches ain' pretty. And yet, there are tons of videos of them out there, and in some of those videos you can see people randomly wandering in and out of the shoot trying to grope muscles, playfully poke abs, stroke Misty's beard, etc. While, in this instance, it is considered "play", this brings about the crux of the point I'm making:

If you enter a place where this kind of behavior is not only accepted, but also encouraged, do you have to surrender the right to be photographed in otherwise compromising positions that you are not comfortable with outside of cons? While the argument about this topic could potentially hinge upon whether or not someone's obsessed with fiction has led them to accept certain behaviors as a social norm when they are, in fact, not, the main pointe is actually whether or not a convention is the proper space for such antics just because there are socially fuckawful nerds there. Some would say that yes, it's a gathering of people who live in their delusions. Others would say that it's a public place like any other... except, it's not, you have to purchase your ticket. It's a private showing.

I would say that whether or not this behavior is socially acceptable is irrelevant; instead, you need to focus on whether or not the con and con staff are willing to allow or overlook this behavior for that con. I, personally, think that cons are so widespread now that having some cons allow it and some cons don't isn't some random nerdy pipedream.

I agree things shouldn't be done without consent, obviously, but at the same time when you enter a public space like a big convention you are automatically granting people permission to photograph or film you. Maybe they're sticking a lens right next to your ass, maybe they're standing 50' away, maybe they're actually taking a photo of something next to you and you happened to walk into their frame. However it occurs, the fact is that filming and photos in public spaces are not in any way prohibited and if you want to control exactly who does and does not film you your one and only option is to not appear in public, or at least not appear in public in such a way as to draw attention, e.g. in cosplay.
