The law that bans Kinder Eggs from the US, the Federal Food Drug and Cosmetics Act, was passed way back in 1938, decades before Kinder Eggs were created. It has a small portion that basically says you can't put non food items inside of a food item, unless the non food item has a practical purpose (like a popsicle stick). Now, this law prevents genuinely deceptive crap like putting a cardboard spacer in something to make it look like there is more food, but also bans toys.
