Technically, yes.
It serves all the same purposes of a sandwich, and the Duke of Earl himself would be proud that it takes the fork out of the equation.

Legally, however, there's a different story.
There was a court ruling in Massachusetts regarding a dispute in a mall food court that had a non-compete clause in the lease prohibiting stands from selling similar food items.
The sandwich stand (Panera) tried to have a neighboring taco stand (Qdoba) removed on the grounds that tortillas were bread-items, and that placing meat between bread served as direct competition.

The court ruled in Qdoba's favor on the grounds that the tortillas aren't actually separate slices of bread. Logically, this could possibly apply to hot dogs, too, on the grounds that it's a roll that's only partially split down the center. But that also leaves an open question for where po'boys and subs fit in the picture, and raises more problems than it actually solves.

By your logic, hamburgers are ontologically different than sandwiches.

This isn't an issue of ontology whatsoever.
This is an issue of colloquial ubiquity where the items in question (hamburger patties or hotdogs) are so firmly associated with a method of preparation that it represents the dish as a whole. The extent that even the buns themselves came to be named after the food they're associated with, even if they are just standard rolls.

A hot dog is a hot dog. A hamburger is a hamburger. A sandwich is a sandwich.
If you put a wiener in a bun, its a hot dog. If you put a wiener between two slices of bread, its a hot dog. If you put it between burger buns, its a hot dog. If you put it in a tortilla, its a hot dog.
If you put a burger patty between two slices of bread, its a burger. If you put it in a tortilla, its a burger. Hell, you could wrap it in lettuce or nothing at all, and its still a burger.
A sandwich is any ingredient that isn't a burger patty or a hot dog wiener between two slices of bread.
This is just common sense. A toddler could figure this out. No reason to complicate things.

I'm not solid on that last part. But at the very least I'd say the dough needs to be baked separately from the items it's served with.
