Because in America, a lot of restaurant owners don't have servers as employees. The servers are self-employed. This loophole allows the owners to pay the servers a service fee that is set by the state. The state has a law that makes sure the server gets x amount of money regardless of how many tips they get. Meaning the owner pays say $2.50 per hour, but the server gets tips totally $10 per hour then the owner doesn't pay anything else. If the server doesn't get any tips at all, then the owner must pay the server the rest of the money so that it will equal minimum wage for that state.

There are a great many owners who don't pay the servers anything, which is illegal and quite normal. Those are mostly pickup jobs for very popular places like dance hall steak houses and clubs where a cute server can make $200 in tips in one night, but might only work 1 night a week.

if they don’t make enough money in tips, they’re paid the amount that brings them to minimum wage. it’s a minimum wage position.
if they’re making more than minimum wage, then they should be happy. if everyone stopped tipping, they’d still be paid the advertised rate.

most servers make well over minimum wage per hour through tips and that’s why they do it. why do you have such a problem with it?

This post is right, though I still hate tipping because of the expectation on the customer it's become for the sake of the employer's pocket. And as I've grown up tipping went from 10 to 10-15 to 20% or the pipe comes out.
