Well I mean there's nothing we can observe without having the intent to observe it. We can limit our observation at that given point in time, but we are still the "observer", even if removed by a few degrees.

If nothing can observe without itself being a source of consciousness or without us deliberately placing it in position to observe, then it can't really be said that to be free of our conscious intent to observe. Making the notion that it is in fact consciousness that is affecting observations more likely and not some passive observation. And if consciousness is able to observe an instantaneous change then consciousness isn't bound to material space-time limitations.
