America has tools such as the bill of rights that can strike down legislation regardless of how visible the moral outcry is. The ruling that I linked before shows this and protects the status quo.

Does canada even have an explict clause prohibiting depictions or is it some interpretation at trial? Knowing one canadian hentai webmaster who actually tried to import loli manga, had it confiscated at the border but recieved no charges, I'm inclined to think the latter.

The UK on the other hand actually added an explict clause all in reaction to some sensationalist reports on pedophiles in Second Life. What a tabloid country.

If you have ever followed an obscenity trial you would know that pornography is not protected by free speech unconditionally. Ashcroft v. Free Speech Coalition would interest /jp/.

This ruling actually prevented the porn producer Max Hardcore from being charged with child pornography based on depictions of minors in his films. He still got hit hard by obscenity charges though, which is as ever defined by the obscure dynamic of "artistic merit".
