Morally or Legally? Morally there are no rights. Legally in the US, all sorts of laws defining private property rights exist. Those laws are only meaningful because the government violently enforces them.

Force, and those you would use it, exist. Therefore to live in a peaceful society use of force is monopolized in the form of a representative government who wield it as they see fit insofar as it continues to represent the will of the people.
