Fair use clauses do exist for a reason, at least in the US. Disney can't just sue you because you drew Mickey mouse goatse rape art, but they can sue you if you intend to financially benefit from their brand. At most, you'd get a C&D if they find whatever you're doing highly objectionable.

A lot of the Nintendo lawsuits happened because people are too damn retarded and use Nintendo assets or try to mimic their content (video games) way too closely which harms their business.

A better explanation of the situation is that murdoch (news corp) is an old fart who feels he isn't making enough money so instead of trying to understand the digital space they are just going to try and force social media and google into paying him for even daring to link to sites he owns. Naturally the government is in his pocket since he owns like 95% of australia media. That's the rough overview of it. A more technical explanation is that google and social media websites are "hosting" their content (linking embeds which displays their click bait title and a clickbait quick overview of the news content which is something the news sites setup themselves) and that they profit from this and are deriving the news site from clicks because of this. They also want google to announce any changes to their algorithm which shuffles their position about (not possible implying even google understands its algorithm at this point).

Both companies are based in Japan, so in japanese court it probably could. If south park did, all hololive could do is throw a fit. The main reason is that Hololive doesn't want to risk getting their image ruined. They are just making a request. The new "rules" are nothing more than a warning saying they will sue if people use their IP without first making a request.
