4) The market has changed because people are specifically watching "your" version of the content and arguably discovered it on your channel and therefore either were already purchasers of viewers of the previous content, or completely unrelated people (Sargon's legal case)

And its still not that simple because music remixes and lets plays can still get struck down sometimes because the music/game company argues that fair use test #4 hurts them because people will turn to the new creator instead of their work. Thats why shit goes to court to begin with.
