It's because of emulation. Mio didn't emulate Ghost Trick, she used capture tech to stream off of her ds, but that's not the point. At the time Ghost Trick was trapped on the DS so unless you still had a cart, you had to emulate. The thing is in Japan emulators are 100% illegal, unlike in the US where emulators are legal but roms are not and everyone just lies about where they got their roms from (I ripped them from the cart I own, honest!). So Capcom saw it as encouraging emulation for people wanting to play it due to her stream. Their "official" answer is that Mio is part of a company, not an individual, and there are different rules on what a business can stream.

Also no, that wasn't the first Capcom video, there were plenty of RE and MH streams before that.
